Proposed Home Building Reforms

Member for Mulgoa, Mrs Tanya Davies MP has welcomed the NSW Government’s release of its proposed reforms to home building laws as part of its plan to stimulate the home building industry.

Fair Trading Minister, Anthony Roberts said the NSW Government has struck a balance between providing homeowner protection while supporting home building activity and investment in NSW, which fell to record lows under the previous Labor Government.

“This is a great step forward in supporting the home builders and owners in our community” said Mrs Tanya Davies.

There are 50 proposed reforms and the Position Paper outlines all the reforms, providing additional information about the key proposals. These include:

  • clarifying the definition for structural or major defects;

  • consolidating licensing provisions to provide for consistent considerations;

  • amending requirements to streamline and rationalise home building contract requirements;

  • establishing a public register of home warranty insurance certificates;

  • renaming the home warranty insurance scheme to better reflect its purpose and how it operates;

  • introducing an expert determination model, which will aim to identify the technical issues in dispute early in the process.
